Privacy Policy  

As Econok Foundation (hereinafter shall be referred to as “Foundation”) is the service provider of https://www.econok.org in which the operation of the website shall collect, process, use or disclose personal data. Therefore, the Foundation provides this privacy policy consistent with the Personal Data Protection Act, 2562 B.E (2019)  as follows:  

1. Definitions  

The definitions of words in this privacy policy shall be in accordance with the Personal Data Protection Act, 2562 B.E. (2019) as follows:

  • “Personal Data” means any information relating to a Person, which enables the identification of such Person, whether directly or indirectly, but not including the information of the deceased Persons in particular;  

  • “Data Controller” means a Person or a juristic person having the power and duties to make decisions regarding the collection, use, or disclosure of the Personal Data;  

  • “Data Processor” means a Person or a juristic person who operates in relation to the collection, use, or disclosure of the Personal Data pursuant to the orders given by or on behalf of a Data Controller, whereby such Person or juristic person is not the Data Controller;  

  • “Person” means a natural person;  

  • “Committee” means the Personal Data Protection Committee;  

  • “Competent Official” means any person appointed by the Minister to perform acts under this Act;  

  • “Office” means the Office of the Personal Data Protection Committee;  

  • “Secretary-General” means the Secretary-General of the Personal Data Protection Committee;   

  • “Minister” means the Minister who is in charge under this Act. 

2. The personal data that the Foundation will collect, process, use and/or disclose. 

The Foundation, as a data controller, will collect, process, use and/or disclose your personal data obtained directly e.g. via the registration on the website or Cookies and indirectly via Cookies. The Foundation will collect, process, use and/or disclose personal data that can identify a person directly or indirectly e.g name, surname, contact information, social media accounts or emails and website usage information as well as other information that can be deemed personal data under the Personal Data Protection Act, 2562 B.E. (2019) including the Foundation will send personal data to the personal data processor or government authorities such as the district office only when necessary within the objectives of the website and the scope of the law.  

If there is any collection, processing, usage and/or disclosure of personal data from another source of information aside from the Cookies, the Foundation will inform you of the personal data and objectives of the collection, processing, usage and/or disclosure in which the Foundation will ask for your consent before committing such acts.  

3. The objectives of collection, processing, usage and/or disclosure of personal data   

The collection, processing, usage and/or disclosure of personal data provided in 2. shall be for the benefits of the Foundation's operational activities which shall include present activities and future planning, evaluate behaviours and trends concerning donations, develop or improve the website user experience and other objectives that are permitted by the Personal Data Protection Act, 2562 B.E. (2019) and other applicable laws.  

However, if there is a change of objectives, the Foundation shall inform you and seek your consent before collecting, process, using and/or disclosing the personal data as required by law.  

4. Providing personal data to abide by the law or contract or to enter into contract with the foundation.   

In case that you have to provide personal data to the Foundation to abide by the law or contract or in a case that you have to provide personal data to enter into contract with the Foundation, the Foundation will inform you of the necessity in these cases, as well as the effects of not providing personal data, on a case-by-case basis.  

5. The period of storing personal data    

The Foundation will store and save your personal data within the Foundation’s database system for a period as long as necessary but not longer than 2 years.  

6. Providing a personal data protection measure  

Regarding the collection, processing, usage and/or disclosure of personal data including sending the personal data to the data processor per this policy, the Foundation will provide personal data protection measures consistent with the standard provide by law to protect against data leaks or the disclosure of personal data without the data subject’s consent.  

7. The rights of the personal data subject  

You, as the personal data subject, shall have the rights according to the Personal Data Protection Act, 2562 B.E. (2019) as follows:

7.1 The right to request access and obtain a copy of the personal data related to him or her which is under the responsibility of the Foundation or request the disclosure of the acquisition of the personal data obtained without his or her consent.  

7.2 The right to receive the personal data concerning him or her from the Foundation.  

7.3 The right to request the Foundation to send or transfer the personal data including the right to request to directly obtain the personal data.  

7.4 The right to object the collection, processing, use and/or disclosure of personal data.  

7.5 The right to request the Foundation to erase or destroy or anonymize personal data to become the anonymous data which cannot identify the data subject.  

7.6 The right to request the Foundation to restrict the use of personal data. 

7.7 The right to request the Foundation to ensure that personal data remains accurate, up-to-date, complete, and not misleading.  

7.8 The right to file a complaint in the event that the Foundation or the data processor including the employees or the service providers of the Foundation or the data processor violates or does not comply with the Personal Data Protection Act, 2562 B.E. (2019) or the notifications issued in accordance with the Act.  

The exercise of the rights outlined in this provision shall be subject to the conditions provided by the Personal Data Protection Act, 2562 B.E. (2019). The Foundation reserves the right to reject such exercise only when there is a valid reason provided by the Personal Data Protection Act, 2562 B.E. (2019) or other applicable laws. 

8. Examination and review of the privacy policy   

The Foundation shall examine and review the privacy policy annually or in the event of changes in the provisions of the laws so that it would be consistent with the Personal Data Protection Act, 2562 B.E. (2019) including other relevant laws, rules or regulations in which the Foundation will publish the revised privacy policy in the Foundation’s website.
